"Zero Tolerance" & Orange County Under 21 DUI Charges
California Vehicle Code Section 23136 contains information specifically regarding under 21 DUI. Under this section, it is illegal for a driver who is under 21 years of age to drive with a blood alcohol concentration of .01% or higher. The officer who pulled the driver over will confiscate his/her driver's license. The driver will then need to schedule a DMV hearing regarding his/her driver's license, which will be suspended if A) the driver loses the hearing, or B) if the driver fails to schedule the hearing within 10 days of his/her arrest.

A driver who is under 21 may also face standard drunk driving charges, involving a blood alcohol concentration (BAC) of .08% or higher. This is most often a misdemeanor offense but may be charged as a felony in some cases.
