Vehicle seizure and impoundment is not always a part of an Orange County DUI arrest. However, in certain circumstances, an officer may decide to impound a vehicle. This typically only applies to those drivers who already have one or more DUI convictions on their record.

If you have a prior Orange County DUI conviction on your record, and you are pulled over for drunk driving, the arresting officer may seize and impound your vehicle if:

• You refuse blood/breath testing to determine your blood alcohol concentration
• Your blood alcohol concentration is .10% or greater

Your vehicle may be impounded for 5 days if you have one prior DUI conviction on your record, and for 15 days if you have two or more prior DUI convictions within the past 10 years. Additionally, you will need to pay all towing costs, storage fees and other administrative charges associated with the vehicle seizure and impoundment - which can add up quickly.

You have the right to a storage hearing regarding your vehicle, and it may be in your best interest to exercise this right.
